Tropical Breeze Car Rental Curaçao

These General Terms & Conditions (“GTC”) form part of the Rental Agreement (“RA”) between Tropical Breeze Car Rental Curaçao (“we”, “us”, “our”) and the renter (“you”, “your”). The Vehicle includes its keys, wheels, tools, accessories and vehicle documents. By renting the Vehicle, you confirm that you have read, understood and accepted these GTC.

Driver requirements
The renter and every additional driver named in the RA must be at least 21 years old, must have held a valid driving licence for at least 3 years, and must be fit and legally permitted to drive. Only drivers named in the RA may drive the Vehicle.

1. Use of the Vehicle
The Vehicle is for normal private use only and must be treated with due care. It may not be used for commercial passenger or goods transport, subletting, towing or pushing another vehicle, racing or competitions, or unauthorized off-road driving. The Vehicle may not be overloaded and all passengers must use designated seats and seat belts.

Local speed limits and traffic rules must be respected. Vehicles may be equipped with GPS tracking. GPS data may be used for vehicle security, theft prevention, roadside assistance, significant speeding, unauthorized off-road use and other situations where reasonably necessary to protect the Vehicle or enforce the RA.

2. Fuel
Fuel is not included unless otherwise agreed. The Vehicle must be returned with the same fuel level as at delivery, as recorded in the RA. If the fuel level is lower, a USD 50 refuelling charge may apply. No refund is given for excess fuel. The renter is responsible for using the correct fuel and is fully liable for damage caused by refuelling with the wrong fuel.

3. Rental period
The minimum rental period is 5 days unless otherwise stated in the RA. The agreed rental period and price are stated in the RA. Returning the Vehicle early does not entitle the renter to a refund. An extension is only possible with prior approval and is subject to availability. The Vehicle must be returned at the agreed date and time. Late return may result in additional rental charges.

4. Payment, cancellation and security deposit
The rental price, agreed extras and applicable charges must be paid in accordance with the RA. A security deposit of USD 750 applies. Tropical Breeze Car Rental Curaçao may waive or adjust the deposit in writing at its discretion. Where a deposit has been collected, it will be released or refunded after the Vehicle has been returned and inspected, provided there is no damage, missing property, unpaid fuel, fines or other outstanding amount. If damage or another claim is pending, the deposit may be retained until the matter has been settled.

Any cancellation conditions stated in the booking confirmation or RA apply. Additional costs arising during or after the rental remain payable by the renter.

5. Inspection, cleanliness and smoking
At delivery, the renter must inspect the Vehicle and immediately report any existing damage or defects so these can be recorded. The Vehicle must be returned in substantially the same condition, subject to normal wear and tear. New damage or missing items may be charged to the renter.

Excessive interior dirt may result in a cleaning fee of USD 100. Smoking is strictly prohibited. If smoking has taken place in the Vehicle, a USD 150 cleaning fee may be charged.

6. Insurance, deductible and liability
WA Plus insurance is included in the rental. The standard deductible/excess is USD 750 per incident. Where offered and agreed in the RA, the deductible may be reduced to USD 250 per incident for an additional daily fee.

The deductible is not a limit of liability where insurance coverage does not apply. The renter may be fully liable for damage or loss caused intentionally, recklessly or through prohibited use, including driving under the influence of alcohol or drugs, using a mobile phone while driving, unauthorized off-road driving, use by an unauthorized driver, providing incorrect driving-licence information, or other use contrary to the RA or these GTC.

The renter is also responsible for damage not covered by the applicable insurance policy and for lost or damaged keys, accessories or other items belonging to the Vehicle.

7. Accident, damage, burglary or theft
In the event of a collision, accident or other damage event, DO NOT MOVE THE VEHICLE unless instructed by Forensys or the authorities. Contact Tropical Breeze Car Rental Curaçao immediately and call Forensys at +599 9 461 3282. Wait for Forensys and follow their instructions. In an emergency or in case of theft, also contact the police/emergency services at 911.

Failure to report the incident properly, failure to obtain the required report, or moving the Vehicle before Forensys arrives may cause insurance coverage to lapse, in which case the renter may be fully liable for the resulting damage and costs.

8. Parking and convertible roofs/sunroofs
When leaving the Vehicle unattended, remove the key, lock the Vehicle, close all windows and close any soft-top or sunroof. Do not leave valuables visible in the Vehicle. Whenever possible, park in a safe, well-lit or secured location.

For Vehicles with a soft-top or sunroof, the roof must be closed when it rains and whenever necessary to prevent damage. Water damage or damage caused by improper use of the roof system may be charged to the renter.

9. Traffic and parking fines
The renter is responsible for all traffic fines, parking fines and related costs arising from violations committed during the rental period, including amounts received after the Vehicle has been returned.

10. Breakdown and flat tires
In case of breakdown or vehicle trouble, contact 24/7 Roadside Assistance Curaçao at +599 9 465 0896 and inform Tropical Breeze Car Rental Curaçao. No paid repair may be carried out without our prior approval.

A flat tire must be dealt with immediately. The renter is responsible for tire repair or replacement costs unless otherwise covered or agreed. The renter is also responsible for damage caused by continuing to drive with a flat tire or by ignoring warning lights or vehicle warnings.

11. Replacement Vehicle
If the reserved Vehicle is unexpectedly unavailable or becomes unusable for reasons not caused by the renter, Tropical Breeze Car Rental Curaçao will make reasonable efforts to provide a comparable replacement Vehicle, subject to availability. If a replacement is supplied by another rental company, that company’s terms may also apply.

12. Personal belongings and applicable law
Tropical Breeze Car Rental Curaçao is not responsible for loss, theft or damage to personal belongings left in or transported in the Vehicle, except where liability cannot legally be excluded.

If any provision of these GTC is held invalid, the remaining provisions remain in force. The RA and these GTC are governed by the laws of Curaçao. Any dispute shall be submitted to the competent court in Curaçao.

Acceptance
By signing the Rental Agreement, the renter confirms receipt of these General Terms & Conditions and confirms that they have been read, understood and accepted.
